Having just a handful of admissible documented facts answering these key questions can often turn a defense theory into a winning defense.  

While the claimant’s research will come to light during discovery, the claimant’s researchers are not searching for documents to support the defense and may not recognize the importance of those documents which do.  Therefore, relying on discovery of the claimant’s historical research may deprive the Defendant of a valuable and powerful tool.
